Matt’s practice focuses on complex civil litigation matters, with an emphasis on business disputes, insurance coverage, and professional liability. Matt has extensive experience representing domestic and foreign insurers in complex coverage disputes arising out of directors and officers, management liability, professional liability, pollution liability, commercial general liability, and excess insurance coverage. Matt frequently provides coverage advice to insurers across a wide range of policies. He also advises insurers in connection with claims against their insureds, and he has experience advising clients drafting policy language.
Matt also has wide-ranging experience representing individuals and businesses in a variety of disputes, including partnership disputes, contract disputes, and disputes concerning allegations of misrepresentations and omissions. In addition, Matt represents clients in the financial services industry with respect to an assortment of claims made against their employees or agents and has experience representing reinsurers in arbitrations.
Matt is a strong supporter of providing pro bono legal services. Recently, he was counsel to the plaintiffs who successfully challenged Texas’ ban on same-sex marriage in De Leon v. Abbott.

- Representing limited partners in partnership dispute concerning breach of fiduciary duties and wind-up responsibilities;
- Representing general partners in partnership dispute with departing partner;
- Representing property owner in lease dispute with tenant;
- Representing underwriters of excess policy issued to an energy company in connection with a dispute over coverage for an SEC enforcement action and bankruptcy adversary proceeding in federal court in Dallas.
- Representing underwriters of D&O, PI, and excess policies in numerous suits brought in state and federal courts relating to the failure of Stanford Financial Group. In one notable case brought in federal court in Houston, underwriters obtained a finding that indicted directors and officers had engaged in acts of money laundering, triggering the policy’s money laundering exclusion. Numerous other cases remain pending.

- Representing underwriters of a D&O policy issued to bank directors in a declaratory judgment action brought in federal court in Atlanta.
- Advising underwriters of pollution legal liability policies relating to a variety of claims for coverage, including claims for remediation costs and litigation expenses.
- Representing underwriters of pollution legal liability policy in coverage dispute in state court in Arizona.
- Representing a domestic insurer in an action against a start-up technology firm seeking to rescind a D&O policy and a declaration of non-coverage under the policy’s prior knowledge exclusion.
- Advising underwriters with respect to a legal malpractice claim arising out of an attorney’s self-dealing in various securities offerings.
- Advising underwriters with respect to legal malpractice claims arising out of tax advice provided to insured law firm’s clients.
- Representing underwriters in coverage dispute arising out of legal malpractice claims made against insured law firm’s lobbying practice.
- Advising insurer on obligations and best practices following mass shooting at insured’s premises.
- Representing insurers in state court and FINRA arbitrations concerning alleged wrongdoing by their employees and agents in connection with their professional advice and investment and insurance-product recommendations.
- Representing defendant in a multiple-plaintiff suit brought in state court in Marin County, California asserting numerous state law tort and statutory claims based on alleged negligence in sponsoring financial education seminars by financial advisors who allegedly made unsuitable investment recommendations to seminar participants.
- Representing underwriters of a D&O policy issued to a healthcare provided in coverage dispute in federal court in Atlanta, Georgia.
- Representing defendant in class action suit brought in state court in Phoenix, Arizona, asserting federal claims based on alleged omissions and misrepresentations relating to the sale of variable annuities for use in qualified plans.
- Representing insurer in Texas state court action alleging insurer’s agent wrongfully induced insured to purchase unnecessary insurance products.
- Defending two major law firm partners in an arbitration arising out of their departure from their former firm.
- Represent domestic insurer in a FINRA arbitration arising out of its alleged agent’s investment recommendations.
- Providing coverage advice for claims to D&O policies arising out of investigations by government agencies, including the SEC and Department of Justice.
- Representing a domestic insurer in coverage litigation in Delaware Chancery Court concerning a Side-A D&O policy.
- Advising domestic insurer with respect to claims for coverage arising out of mortgage company’s allegedly wrongful foreclosure practices.
- Advising and representing domestic CGL insurer in coverage dispute with construction-materials manufacturer arising out of dozens of claims against manufacturer for allegedly faulty product.
- Advising domestic insurers with respect to lawsuits by former employees and/or their families for catastrophic workplace injuries.
